The distribution of ShUT assets are detailed in the minutes of the final meeting held on 19 March 2012,

Hello ShUT Members,
As you are aware, the development application DA09/2077 to establish a waste facility at the Tomerong Quarry site was defeated in October 2010, much to the delight of ShUT members. The proponent has also failed to lodge an appeal and the timeframe to do so has now elapsed. Therefore, it has been deemed that ShUT Campaign Incorporated now serves no useful purpose and it is intended to request deregistration of the association.
A general meeting will be held at Tomerong School of Arts hall on Monday 19 March commencing at 7.30 p.m. The purpose of the meeting will be to propose a special resolution to:
1. approve the cancellation of the registration and
2. propose the distribution of ShUT assets
All members and friends are most welcome to attend. We hope to see you there.

thousands of hours of organising and/or participating in public awareness activities, research, formal meetings, informal meetings, emails, letters, hundreds of pages of minutes, flyer distribution, active lobbing, phone calls, TV and radio headlines, newspaper columns, media mentions, etc.
The following is a brief overview of some of the highlights of the short, inconvenient, but

26/08/09 Shoalhaven City Council (SCC) notification of DA 09/2077 and 30 days given for public submissions.
12/09/09 Public meeting called to discuss DA 09/2077. ShUT Steering Committee formed.
16/09/09 first ShUT Meeting. ShUT establishes specialist groups to utilise limited resources. EIS (Environmental Impact Statement) investigation, Public awareness, Media, Lobby and Research groups.
First batch of 33 x 600x900mm „No Tip‟ signs distributed to highly visible road side vantage points. Public Awareness Group books local market stalls and distributes flyers.

13/08/10 - Last day for public comment for Noise attenuation „Great Wall of Tomerong‟ resulting in almost another hundred submissions against the Tip proposal.
02/09/10 - ShUT requests a review from newly formed State Office of Information for FOI GTA related internal documents, not forthcoming from the DECCW (To date still no decision from the State office of Information).
08/10/10 - SCC Planning department autonomously rejects the Tip Proposal DA 09/2077 on 10 major points in a 100 page refusal.
11/10/10 - at the SCC Regional Development Committee meeting, ShUT member, Richard Bates makes a convincing 10 minute presentation to Councillors. Councillors unanimously support the planning department‟s rejection of DA 09/2077 and also endorse ShUT's comments on the rejection document, in the SCC councillors separate submission to the JRPP.
21/10/10 - at the SCC meeting rooms the JRPP hears the developers presentation and more submissions against the DA including a hurried ShUT „New Information‟ presentation before unanimously refusing the Tip Proposal 3:0.
14/11/10 - ShUT holds celebration party at the Tomerong School of Arts Hall with speeches from Peter Allison, John Levett and Rebecca Rudd.
During these 16 months, two prominent members of ShUT are taken seriously ill, possibly due to frustration and stress relating to the DA.
ShUT"s investigations have shown that the DECCW methods and approval processes seem to have been woefully compromised during this DA.
ShUT has also unearthed many non-compliance issues with the current Quarry operation, that formed part of ShUT‟s case. This information will now be passed on to the Tomerong Forum, Community Consultative Body (CCB) to continue the communities fight against inappropriate development activities in our local area.
All this work has shown that an existing, operational, locally organised, unaligned, independent body, possibly like Tomerong Forum, can be an imperative front line facility, in the fight against inappropriate local development. CCB‟s are our voice to the SCC on a community level...

The Joint Regional Planning Panel (JRPP) will hold the Determination meeting for DA 09/2077 on Thursday 5pm 21/10/10 at the Shoalhaven City Council (SCC), Council Chambers, Administration building. Invited persons wanting to speak at the meeting must register to speak before Wednesday 20/10/10 (There is an error in the actual JRPP letter stating that the deadline to register is 12/10/10. This has since been corrected to 20/10/10). JRPP Notice of Panel Meeting. The JRPP have stated that only NEW information will be heard at this meeting.

The Shoalhaven City Council (SCC Councillors present) have unanimously voted in support of The SCC Planning Department's 79c recommendations to REFUSE the DA 09/2077 at the SCC Regional Development Committee (RDC) Meeting tonight. The 10 major points of refusal very briefly:
1. Does not comply with the requirements of SEPP 33.
2. Does not comply with Clauses 9(a) to (d), 11(a) and (b); or 13(1) of the Jervis
Bay Regional Environmental Plan (JBREP).
3. Does not comply with ‘Objectives’ 1(b), 1(c)(i), 1(c)(iv) and 1(c)(v) of the 1(d) (Rural “D” (General Rural) Zone as detailed in Clause 9 of Shoalhaven Local Environmental Plan 1985 (SLEP 1985).
4. The proposal is likely to intercept or use groundwater and the need for a water license under Part 5 of the WA 1912 has not been addressed, in terms of further surface and groundwater modelling. Without this level of detail, there are concerns that the potential of leachate contaminating both the surface and groundwater tables in this location could pose a significant and adverse impact on the sensitive environs of St Georges Basin and the Jervis Bay Marine Park.
5a. The application is deficient in terms of providing an adequate assessment on how threatened species, their populations, ecological communities and/or habitats will be impacted by the subject proposal in this locality, as required under s5A of the NSW EP&A Act.
5b. The location of the intended noise attenuation barrier being proposed within an area indentified as “Land of Ecological Sensitivity” (Clause 21 of SLEP 1985).
6. The applicant has failed to submit any information detailing how the proponent expects to “avoid or mitigate the threat from bushfire” as a consequence of the proposed land activity in accordance with Clause 28 (Danger of Bushfires) of SLEP 1985.
7. There will be an unacceptable impact from the intensification of additional truck movements on Gumden Lane and Council’s road network given that there has not been any long term, on-going proposal for road maintenance put forward. In addition, without the necessary road maintenance, there will be a detrimental impact on the existing and future amenity of those residents’ living in close proximity to the subject site, in terms of additional offensive ‘noise’ and an unreasonable increase in truck traffic.
8. Appropriate details of screening procedures have not been provided which satisfactorily address how all prohibited materials will be adequately recovered from every truck laden with material.
9. The subject site is considered to be an unsuitable use of the subject land.
10. The proposed development is not considered to be in the “Public Interest”.

Many of you will have received notification from Shoalhaven City Council with regard to the Council's Regional Development Committee meeting to be held on Monday 11 October at Shoalhaven City Council, commencing at 6 p.m. A copy of the letter to residents can be found at the following link:

The JRPP 'Public Briefing' was held today with 17 individuals and community groups presenting issues to the panel, including John Hatton (ex Member for South Coast), Councillor Amanda Findley, Councillor John Furgeson, and a reluctant Mayor Paul Green. A notable absence was a representation from the DECCW who were invited. The Tomerong Hall was full to overflowing. The meeting was well managed and seemed to to convey the point that the DA was 'not in the public interest'. A transcription of the ShUT presentation to the briefing should be on the 'Shut Correspondence' page when time permits (by about 12/07/10) and also a general summary of the event will be linked on this news page. The Joint Regional Planning Panel (JRPP) will hold the Determination meeting for DA 09/2077 on Thursday 5pm 21/10/10 at the Shoalhaven City Council (SCC), Council Chambers, Administration building. Invited persons wanting to speak at the meeting must register to speak before Wednesday 20/10/10 (There is an error in the actual JRPP letter stating that the deadline to register is 12/10/10. The Shoalhaven City Council (SCC Councillors present) have unanimously voted in support of The SCC Planning Department's 79c recommendations to REFUSE the DA 09/2077 at the SCC Regional Development Committee (RDC) Meeting tonight. The 10 major points of refusal very briefly:
1. Does not comply with the requirements of SEPP 33.
2. Does not comply with Clauses 9(a) to (d), 11(a) and (b); or 13(1) of the Jervis
Bay Regional Environmental Plan (JBREP).
3. Does not comply with ‘Objectives’ 1(b), 1(c)(i), 1(c)(iv) and 1(c)(v) of the 1(d) (Rural “D” (General Rural) Zone as detailed in Clause 9 of Shoalhaven Local Environmental Plan 1985 (SLEP 1985).
4. The proposal is likely to intercept or use groundwater and the need for a water license under Part 5 of the WA 1912 has not been addressed, in terms of further surface and groundwater modelling. Without this level of detail, there are concerns that the potential of leachate contaminating both the surface and groundwater tables in this location could pose a significant and adverse impact on the sensitive environs of St Georges Basin and the Jervis Bay Marine Park.
5a. The application is deficient in terms of providing an adequate assessment on how threatened species, their populations, ecological communities and/or habitats will be impacted by the subject proposal in this locality, as required under s5A of the NSW EP&A Act.
5b. The location of the intended noise attenuation barrier being proposed within an area indentified as “Land of Ecological Sensitivity” (Clause 21 of SLEP 1985).
6. The applicant has failed to submit any information detailing how the proponent expects to “avoid or mitigate the threat from bushfire” as a consequence of the proposed land activity in accordance with Clause 28 (Danger of Bushfires) of SLEP 1985.
7. There will be an unacceptable impact from the intensification of additional truck movements on Gumden Lane and Council’s road network given that there has not been any long term, on-going proposal for road maintenance put forward. In addition, without the necessary road maintenance, there will be a detrimental impact on the existing and future amenity of those residents’ living in close proximity to the subject site, in terms of additional offensive ‘noise’ and an unreasonable increase in truck traffic.
8. Appropriate details of screening procedures have not been provided which satisfactorily address how all prohibited materials will be adequately recovered from every truck laden with material.
9. The subject site is considered to be an unsuitable use of the subject land.
10. The proposed development is not considered to be in the “Public Interest”.

The JRPP 'Public Briefing' was held today with 17 individuals and community groups presenting issues to the panel, including John Hatton (ex Member for South Coast), Councillor Amanda Findley, Councillor John Furgeson, and a reluctant Mayor Paul Green. A notable absence was a representation from the DECCW who were invited. The Tomerong Hall was full to overflowing. The meeting was well managed and seemed to to convey the point that the DA was 'not in the public interest'. A transcription of the ShUT presentation to the briefing should be on the 'Shut Correspondence' page when time permits (by about 12/07/10) and also a general summary of the event will be linked on this news page. Shoalhaven City Council (SCC) issues "Notification of a Regional Development Application, Proposed Amendment to an Existing Designated Development". Referencing DA 09/2077 notification to residents for an 'approximately 400m long x 5m high Noise Attenuation Wall' near Gumden Lane. This effectively reopens the gate for submissions for the whole DA 09/2077 proposed waste facility, so if you didn't send in a Submission last time then this is your big chance! Submissions must be received by the 13/08/10.
Some points of concern that could be used in Submissions of Objection to Council can be found on our 'Write a Submission to Council - Instructions' page, to get youself and other concerned residents started. If enough letters of objection are received by the SCC then it may be rejected as "Not in the Public Interest".

The SCC has Circulated a 'Notice of Development and/or subdivision Application' to a few residents in Gumden Lane using the DA09/2077 reference number. This DA is for "A proposed 5 metre high noise attenuation barrier located along the Eastern side of Gumden Lane which has been designed to reduce the associated truck noise, as a result of the existing quarry and proposed non putrescible waste facility operations, from emanating onto the existing tourist development located at lot 3 DP 775296 Bayly Rd, Tomerong."

Update....The DA09/2077 application process is waiting for a decision from the 'Department of Environment Climate Change and Water' (DECCW, old EPA) to approve or reject the issue of an 'environmental licence' for the 'waste facility' operation. The DECCW previously rejected DA09/2077 with reasons in mid February 2010. The applicant attempted to address these DECCW concerns on 09/04/10. It is assumed that a DECCW decision will be announced shortly. When the DECCW decision is made, it will be logged here. If the DECCW rejects the waste facility environmental licence, then there is no reason for the application to go further.

Greens' MP rubbishes tip plans
The New South Wales Greens say plans to build a tip at Tomerong, west of Jervis Bay, are flawed. The Greens have raised a number of issues regarding the plans for the tip, questioning the sense in building a major waste facility in the Jervis Bay catchment area.
Greens' MP Silvia Hale says locating the tip in an old quarry raises doubts as to whether the site can be adequately secured against leakage.
She says previous blasting and rock fracturing at the proposed site calls into question whether waste material could be kept out of Tomerong Creek, which feeds into Jervis Bay.
She says a safety precaution like a dam may not be enough protection.
"The problem with building a dam is that dams are capable of breaking, of leaking, and particularly if you have a very severe weather event there's the prospect of the dam giving way," she said.
"The area where the tip is proposed is already flood prone, so I would be very worried about the dam being breached."
Ms Hale says she is also worried that the power to make decisions about the tip has been removed from the community and given to a Joint Regional Planning Panel.
She says this means those affected most by planning decisions have little say in them.
"Whatever you think of the local council, you do have the opportunity every four years to vote in elections and possibly completely change your councillors, but with appointed Government panels you don't have that opportunity," she said.
"It's incredibly undemocratic and a way the Government has devised of turning its back on community opinion."

Shut has sent a letter to the SCC and JRPP describing the 'social impacts' damage that the ongoing DA is having on the community and asking for an end to any more extensions of time given by the SCC for the applicant to lodge outstanding papers.
Social Impacts are the changes in people, families, and communities resulting from an event, in this case the lodging and future prospects of DA09/2077.

On 09/04/10 the applicants of DA09/2077 Watkinson Apperley Pty Ltd for the proponents Tomerong Waste Pty Ltd, have lodged a one hundred odd page document at the eleventh hour in an attempt to address issues raised by the SCC and the DECCW relating to the DA. This document can be seen on the SCC website (see entry 05/03/10, below). Note: Some people are experiencing problems opening the 45Mb .pdf document. Hopefully this will be resolved soon.

Shoalhaven City Council (SCC) issues "Notification of a Regional Development Application, Proposed Amendment to an Existing Designated Development". Referencing DA 09/2077 notification to residents for an 'approximately 400m long x 5m high Noise Attenuation Wall' near Gumden Lane. This effectively reopens the gate for submissions for the whole DA 09/2077 proposed waste facility, so if you didn't send in a Submission last time then this is your big chance! Submissions must be received by the 13/08/10.
Some points of concern that could be used in Submissions of Objection to Council can be found on our 'Write a Submission to Council - Instructions' page, to get youself and other concerned residents started. If enough letters of objection are received by the SCC then it may be rejected as "Not in the Public Interest".
This will set back the JRPP determination of the DA to 03/09/10 or 21-22/10/10 which are their next available free dates for sitting in the Southern Region.

What now
Below is a simple brief summary of the overall DA process from about now.
- As the DECCW has now granted general terms of approval with conditions, for DA 09/2077.
- The SCC planning department finalises its 'Section 79c' recommendation document and sends it to the JRPP (sidestepping the locally elected SCC councillors determination process).
- The JRPP may organise a preliminary meeting with the public.
- The JRPP makes a decision on the DA.
- The JRPP sets a determination date and suitable venue where authorised people will be invited and allowed a limited time to speak about the DA. Authorised people may be some or all people who lodged a written submission to the SCC concerning DA09/2077 (about 700 people). This may be about mid August.
- The JRPP may require more time to deliberate the DA after public submissions (If any 'new' relative information is presented).
- The JRPP will then hand down one of three possible determinations (reject, approve or approve with conditions) which will either agree with the SCC 'section 79c' or disagree.
- If the JRPP determination disagrees with the SCC 'Section 79c' recommendation document, the SCC will go back and reevaluate the DA.
- When the SCC 'Section 79c' report agrees with the JRPP determination (reject, approve or approve with conditions) then that will be the determination.
- Then the SCC will take the determination and act as the 'Consenting Authority' as per normal.

The SCC has Circulated a 'Notice of Development and/or subdivision Application' to a few residents in Gumden Lane using the DA09/2077 reference number. This DA is for "A proposed 5 metre high noise attenuation barrier located along the Eastern side of Gumden Lane which has been designed to reduce the associated truck noise, as a result of the existing quarry and proposed non putrescible waste facility operations, from emanating onto the existing tourist development located at lot 3 DP 775296 Bayly Rd, Tomerong."

Update....The DA09/2077 application process is waiting for a decision from the 'Department of Environment Climate Change and Water' (DECCW, old EPA) to approve or reject the issue of an 'environmental licence' for the 'waste facility' operation. The DECCW previously rejected DA09/2077 with reasons in mid February 2010. The applicant attempted to address these DECCW concerns on 09/04/10. It is assumed that a DECCW decision will be announced shortly. When the DECCW decision is made, it will be logged here. If the DECCW rejects the waste facility environmental licence, then there is no reason for the application to go further.

Greens' MP rubbishes tip plans
The New South Wales Greens say plans to build a tip at Tomerong, west of Jervis Bay, are flawed. The Greens have raised a number of issues regarding the plans for the tip, questioning the sense in building a major waste facility in the Jervis Bay catchment area.
Greens' MP Silvia Hale says locating the tip in an old quarry raises doubts as to whether the site can be adequately secured against leakage.
She says previous blasting and rock fracturing at the proposed site calls into question whether waste material could be kept out of Tomerong Creek, which feeds into Jervis Bay.
She says a safety precaution like a dam may not be enough protection.
"The problem with building a dam is that dams are capable of breaking, of leaking, and particularly if you have a very severe weather event there's the prospect of the dam giving way," she said.
"The area where the tip is proposed is already flood prone, so I would be very worried about the dam being breached."
Ms Hale says she is also worried that the power to make decisions about the tip has been removed from the community and given to a Joint Regional Planning Panel.
She says this means those affected most by planning decisions have little say in them.
"Whatever you think of the local council, you do have the opportunity every four years to vote in elections and possibly completely change your councillors, but with appointed Government panels you don't have that opportunity," she said.
"It's incredibly undemocratic and a way the Government has devised of turning its back on community opinion."

Shut has sent a letter to the SCC and JRPP describing the 'social impacts' damage that the ongoing DA is having on the community and asking for an end to any more extensions of time given by the SCC for the applicant to lodge outstanding papers.
Social Impacts are the changes in people, families, and communities resulting from an event, in this case the lodging and future prospects of DA09/2077.

On 09/04/10 the applicants of DA09/2077 Watkinson Apperley Pty Ltd for the proponents Tomerong Waste Pty Ltd, have lodged a one hundred odd page document at the eleventh hour in an attempt to address issues raised by the SCC and the DECCW relating to the DA. This document can be seen on the SCC website (see entry 05/03/10, below). Note: Some people are experiencing problems opening the 45Mb .pdf document. Hopefully this will be resolved soon.

To increase awareness of the proposed waste facility DA 09/2077 in the Shoalhaven. The ShUT group placed quite a few signs in high visibility locations (mostly on private property). The majority of these signs have been removed by person/s unknown. In early January this sign removal process was compounded by the Shoalhaven City Council Rangers Department, contacting ShUT and demanding ShUT to remove all signs on public property within 72 hours. This demand was in response to an apparent detailed written complaint. ShUT complied with this demand promptly.
If you would like to draw attention, and show your opposition to 'The Proposed Waste Facility' upstream from Huskisson, Vincentia, St Georges Basin and Sanctuary Point, you may consider downloading, printing and displaying a (Shoalhaven, Jervis Bay or St Georges Basin) 'No Tip' A4 or A5 (1/2 A4) sign on your fence, window, car, etc.. 16/10/09 Public submissions to Shoalhaven Council end with over 700 submissions lodged. This is a record for the Shoalhaven City Council.

30/09/09. ShUT Flyer and Membership Form
29/09/09. A Resident's Briefing Meeting has been scheduled for 1 October 2009 at Vincentia High School commencing at 7.00pm. As per Council's Community Consultation Policy. According to Shoalhaven City Council "All interested members of the public are invited to attend."
21/09/09. The Shoalhaven City Council has unanimously this evening voted for an extension of 21 days (ending 16 October 2009) to submit objections to the proposed Tomerong Mega Tip.
At very short notice there will be a ShUT Rally outside the gates of the Quarry on Gumden Lane on 22/09/09

ShUT first meeting held with an attendance of around twenty, agreeing on the best utilisation of limited resources by organising 5 key groups: 1, Steering. 2, Public Awareness. 3, Environmental Impact Statement (EIS) investigation. 4, Media. 5, Research (later merged with EIS)
12/09/10
Public meeting held at Tomerong School of Arts Hall with over 200 concerned residents attending. ShUT campaign organisation concept adopted and a working group created.
04/09/10. Public meeting called by concerned residents for concerned residents to discuss the DA 09/2077 and organise a unified response.
03/09/10. In a knee jerk reaction, www.notomerongtip.com published to the web at short notice (archived at http://notomerongtip.weebly.com/index.html) . Website later closed on 01/12/09 in favour of this ShUT endorsed website.
26/08/09. Notice of Development Application 09/2077 for a Waste Facility posted by Shoalhaven City Council (SCC) to few residents living nearby the effected property. 21 days given for concerned residents to respond.
20/08/09. The Development Application 09/2077 for a Waste Facility was made to Council. Note: No community consultation was made to the surrounding neighbours or greater community before 26/08/09.
